CDC Mask Mandate Overturned

Cdc Mask Mandate Overturned – There is no doubt that the Centers for Disease Control and Prevention has been doing a tremendous job during the pandemic of novel coronavirus. From the very first day, CDC is more active than any other Health department branch of the country.

Starting from creating COVID protocols, CDC has been actively providing guidance based on the latest data and developments. At the same time, you can also get yourself tested for novel coronavirus in any town or city in the United States.

For the last 18 months, the Centers for Disease Control and Prevention have been trying to Vaccinate every American. that is why CDC partnered with several pharmaceutical chains to provide all these services without any cost to Americans.

But, This doesn’t mean that everyone will like the steps taken by the Centers for Disease Control and prevention. That is why, recently, a Florida judge overturned the mask mandate issued by the Centers for Disease Control and prevention. The judge believed that CDC overstepped its authority while issuing mandates for masks.

Judge Overturned CDC Mask Mandate

A few days ago, the Centers for Disease Control and Prevention issued a mask mandate which made the mask compulsory on Public transport.

Most legal experts believe that the mandate is well within the boundaries of the agency, which will help the agency to prevent the spread of novel coronavirus across the nation. But the mandate was recently overruled by a federal court judge in Florida.

As per the judge, the Centers for Disease Control and prevention had exceeded its authority under the law and passed the illegal mandates. She further questioned the use of masks during the pandemic.

Now the whole mandate is on hold, which means you are not legally bound to wear a mask while traveling in public transport, including planes, buses, trains, and the subway.

Several domestic airlines have already started the use of masks, and as per the latest statement, passengers can take the mask off. [Source]

The CDC has a right to issue any mandate related to public health, and the CDC mask mandate is just an example of its power. The whole mandate is in favor of the general public, and it has already been cleared that masks are the biggest weapon in fighting against novel coronavirus.

Even the public health experts worry about the ruling and any future guidelines issued by the Centers for Disease Control and prevention to ensure the safety of Americans.

As for several legal experts, the latest overruled decision is going to hamper the ability to respond to future outbreaks of novel coronavirus. At the same time, people are going to question the authority of the agency more.

In a statement issued by Lawrence Gostin, if CDC can’t impose an unitrust requirement to wear masks to prevent the virus from going from state to state, then it has no power to do anything.

Lawrence Gostin is completely right. If any new wave comes to the United States, then everyone will blame the Centers for Disease Control and prevention for not preparing enough to ensure the safety of Americans.

Previous incidents

A similar incident also happened last year when the Supreme Court of the United States said that the Centers for Disease Control and Prevention had overstepped its boundaries by imposing an eviction ban during the pandemic.

The Centers for Disease Control and prevention do not have any right to issue any ban or something related to the economy as they are a health agency. Since then, people have been questioning everything the CDC is doing these days.

Legal experts have been criticizing the latest move of overruling the CDC mask mandate as there is a huge difference between the eviction and mask mandate case. During the eviction ban case, the Centers for Disease Control and prevention was overstepping its boundaries, and it was necessary back then.

But this time Center for Disease Control and prevention used its given authority to issue the latest CDC mask mandate to ensure the safety of every passenger in public transport.

Takeaways

As soon as the CDC mask mandate was overruled, Several health and legal experts raised their concerns related to the judgment as it is completely unjust and once sided. The Center for Disease Control and Prevention was well within its boundaries to issue the mandate, and the latest overruling bill questions anything CDC is going to do in the future.

What could be the next move of the CDC after Its previous mandate was overruled?

The next battle is going to be very interesting as CDC has already prepared its next move.
